The foundation for a successful Tribunal claim

Helping you translate what happened into legal claims

A step-by-step guide through the process of translating issues into the language of legal claims, flagging important legal tests you need to consider.

Heading: What is this claim for?

Remember, you can make more than one claim for the same events. In fact, it’s very common in tribunal cases to bring multiple related claims. Once you finish this claim just add another.

What is a Schedule of Loss for an Employment Tribunal?

If you’re successful with your claim, the Tribunal needs to know what you’re looking for as an outcome. A Schedule of Loss lists all the losses that you have incurred as a result of your employer’s treatment.

This template helps you set out a clear and professional Schedule of Loss for Employment Tribunal.

Examples of preparing a Schedule of Loss for Employment Tribunal

It can be difficult to know what exactly you should ask for in your Schedule of Loss, especially when it comes to an unfair dismissal, victimisation, or discrimination. Here are a few examples of how to prepare a Tribunal Schedule of Loss:

Example

Peter has made an Employment Tribunal claim for unfair dismissal.

He has been ordered by the Tribunal to prepare a Schedule of Loss.

Peter uses Valla to prepare his Schedule of Loss listing out the compensation that he is asking for, including his basic award and compensatory award.

Example

Lottie has made an Employment Tribunal claim for victimisation and direct sex discrimination.

Lottie uses Valla to prepare her Schedule of Loss listing out the compensation she is asking for, including loss of earnings and injury to feelings.

Example

What to do after you’ve prepared a Schedule of Loss for Employment Tribunal

  1. create the Schedule of Loss
  2. send the Schedule of Loss to the Respondent
  3. make sure that the Schedule of Loss is included in the Hearing Bundle so that everyone can refer to it during the hearing if needed
  4. bear in mind that it’s very normal to have to update your Schedule of Loss later on. This is especially if you’ve prepared your original one a long time before the Tribunal has to decide on the remedy to be awarded.

Save time, reduce stress and ensure your claim has the best chance of success
