What is a Case Management Order for Tribunal
An Employment Tribunal Case Management Order is an instruction for you to do something by a certain date. This may include providing evidence and documents to the Tribunal and disclosing and exchanging evidence with your employer. It may be helpful for you to propose Case Management Orders, along with your employer if possible.
Ultimately, it’s up to the Judge to decide on what Case Management Orders to make and the deadlines, however if you’re able to agree with your employer, the Tribunal is likely to follow your lead.
A helpful proposed Case Management Orders Example
Proposing your own Case Management Orders may be very helpful for your case. It allows you to have a say in controlling the pace. The following is an example of what this might look like:
Marlon has a Case Management Preliminary Hearing coming up. He is in the process of completing his Case Management Agenda and sees that this asks questions about the dates for exchange of Lists of Documents, witness statements etc.
He uses Valla to create proposed Case Management Orders to suggest a timetable for how he wants the case to run. He sends this to the Respondent for them to review and agree. Once this has been done, he sends the proposed Case Management Orders to the Tribunal along with the Case Management Agenda.
How you can propose Case Management Orders
Once you’ve got a good draft Case Management Orders document, you can apply to the Tribunal. You should:
- agree the proposed Case Management Orders with the Respondent if possible
- send the proposed Case Management Orders to the Tribunal, along with the Case Management Agenda, copying in the Respondent
- attend the Preliminary Hearing.
