How to apply for an Employment Tribunal Postponement of Hearing
Use this template in any circumstance where you need to ask the Employment Tribunal for a postponement of hearing, or if you need your case to be adjourned part way through.
Examples of when you would use an Application for Postponement of Preliminary/Final Hearing
Generally, to postpone or adjourn a hearing, you would need to apply to the Tribunal. This could include, for example, adjournment on medical grounds which mean you can no longer attend the hearing, or where you are trying to settle the case and this looks likely to succeed. For example:
Olja has a Case Management Preliminary Hearing coming up, but she has been negotiating with her employer about settling out of court and it looks very likely that a settlement will be reached soon.
She applies for a postponement since she’s likely to be able to withdraw her claim soon.
Jarrod’s Final Hearing has been scheduled to last for two days over video hearing.
Jarrod tests positive for Covid after the first day, and is feeling too unwell to continue.
He applies for an adjournment so that the hearing can be completed at a later date.
How to request a postponement for Employment Tribunal
Once you’ve filled out your template with Valla, it’s important to know the next steps in how to postpone an Employment Tribunal case. You should:
- create the template in Valla
- send the application letter or email to the Tribunal
- copy in the Respondent
- wait for the Tribunal to confirm whether or not the postponement or adjournment will be granted
- chase the Tribunal by phone if you don’t hear from them
- don’t assume that the application has been granted until the Tribunal have confirmed this.
